Welcome to Bloomie Companion ("the Service"), a product of Bloomie Inc.
The Service provides an AI-powered platform designed to bring transparency and quality assurance to the online tutoring market for learners aged 5-18. The Service joins online lessons to analyze transcripts, generate pedagogical insights, provide detailed reports for parents/guardians, and offer professional development feedback for tutors.

2. Acceptance of Terms

By accessing or using the Service, you accept and agree to be bound by these Terms of Use ("Terms"). These Terms apply to all users, including tutors, parents, or legal guardians managing learner accounts.

3. Eligibility

The Service is designed for use by tutors and parents (or legal guardians) on behalf of learners aged 5 to 18. To create an account and use the Service, you must be at least 18 years old.

4. Account Registration and Responsibilities

• You are responsible for maintaining the confidentiality of your account login credentials.
• You agree to provide accurate and complete information during registration and to keep this information up to date.
• Parents are solely responsible for creating and maintaining accurate learner profiles. Tutors may only provide services to a learner after a parent or legal guardian has created a profile and explicitly assigned that learner to the tutor within the Service.

5. Use of Service

The Service offers features for tutors and parents, including:

• An in-app calendar for scheduling online lessons.
• AI-generated learning objectives based on curriculum standards to assist with lesson planning.
• AI-powered analysis of lesson transcripts to generate detailed session reports.

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Access or attempt to access data, content, or services not intended for you.
• Misrepresent your identity or affiliation with any person or entity.

6. Intellectual Property

All content and software associated with the Service, including but not limited to the user interface, reports, AI-generated analysis, and branding, is the exclusive property of Bloomie Inc. Unauthorized reproduction, modification, or distribution is strictly prohibited.

7. Data Privacy and Security

Bloomie Inc. is committed to protecting your data. Our collection and use of personal information in connection with the Service is described in our Privacy Policy.

8. Limitations of Liability

Bloomie Inc. is not liable for:

• Errors, interruptions, or technical issues you may experience. We will use reasonable efforts to ensure the Service functions as intended.
• Inaccuracies in AI-generated reports or analysis. The Service is intended as a supportive tool and not a definitive judgment of teaching quality.
• Unauthorized access to your account due to your failure to secure login credentials.
• Loss of data or user-provided content.

9. User-Generated Content

You grant Bloomie Inc. a worldwide, royalty-free license to use, process, and analyze this User Content (specifically Learner Profiles, Lesson Plans, and Lesson Transcripts) to provide and improve the Service, including the training of our AI models. However we do not use your name, email address, or other data collected during your account sign-up via Google or otherwise to train our AI models.

10. Termination of Access

We reserve the right to suspend or terminate your access to the Service at our discretion if you violate these Terms or engage in activities that are harmful to the Service or our community.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be resolved in the jurisdiction of Nigeria.

12. Amendments to Terms

Bloomie Inc. may update these Terms periodically. We will notify users of significant changes through the Service or by email. Continued use of the Service after such changes constitutes your acceptance of the new Terms.
